General Terms and Conditions

1. Scope

1.1 These General Terms and Conditions (GTC) govern the legal relationship between you ("customer") and one idea gmbh, Bertiswilstrasse 2, 6023 Rothenburg, Switzerland ("Iris Foto Schweiz" or "we") for bookings, orders, deliveries, and services.

1.2 By booking an appointment, ordering a voucher, or any other service, you accept these GTC in the version current at the time of booking.

1.3 Different or supplementary conditions of the customer shall only apply if we have confirmed them in writing.

2. Services

2.1 Iris Foto Schweiz offers the following services: iris photo shoots at various locations in Switzerland, sale of vouchers, sale of wall art and printed products.

2.2 We provide the equipment required and the professional know-how for the execution.

2.3 The creative execution of the photographic work is at our discretion, unless otherwise agreed in writing.

3. Conclusion of contract

3.1 The presentation of our services on the website does not constitute a binding offer, but an invitation to submit an offer.

3.2 By submitting an online booking, you make a binding offer. The contract is concluded with our confirmation by email.

3.3 Instant bookings with immediate payment are deemed bindingly concluded upon receipt of payment.

4. Prices and payment terms

4.1 All prices are in Swiss francs (CHF) including statutory VAT.

4.2 Payment methods for online bookings: credit card (Visa, Mastercard) and TWINT (once activated). Additional payment methods will be added on an ongoing basis.

4.3 Vouchers are sold against invoice, payable within 10 days. The voucher is delivered by email upon receipt of payment.

4.4 In case of payment delay, reminder fees of CHF 20.- per reminder will apply. After the third reminder, the claim is referred to a debt collection agency.

4.5 Invoices for wall art and printed products are payable within 10 days from the invoice date.

5. Cancellations and rescheduling

5.1 Rescheduling by the customer:

Rescheduling of an appointment by the customer is possible as follows:

• More than 48 hours before the appointment: free of charge
• 48 to 24 hours before the appointment and new appointment within 6 days: CHF 50.-
• 48 to 24 hours before the appointment and new appointment more than 6 days later: CHF 100.-
• Less than 24 hours before the appointment and new appointment within 6 days: CHF 100.-
• Less than 24 hours before the appointment and new appointment more than 6 days later: CHF 150.-

The rescheduling fee is paid immediately during the rescheduling process by credit card or TWINT. The rescheduling only takes effect once the payment has been successfully received.

5.2 Cancellation by the customer:

The following fees apply to cancellations by the customer:

• More than 48 hours before the appointment: free of charge
• 48 to 24 hours before the appointment: CHF 50.-
• Less than 24 hours before the appointment: CHF 100.-
• No-show without notice: full shoot cost according to the booked package (currently CHF 120.- to CHF 599.-)

Cancellation is made via the personal cancellation link in your booking or reminder email, or informally by email to hello@oneidea.ch. The receipt of your cancellation notice by us is decisive for the calculation of the deadline.

5.3 Cancellation by Iris Foto Schweiz: we reserve the right to cancel appointments for important reasons. In such cases, we offer an alternative date or refund the full amount.

6. Vouchers

6.1 Available online or in our studios.

6.2 Validity: 1 year from the date of issue. The voucher expires after this period without replacement.

6.3 The voucher must be presented when booking the appointment or on site (digital or printed).

6.4 Vouchers are transferable. A cash payout of the voucher value is excluded.

6.5 Withdrawal: within 14 days of order, informally by email to hello@oneidea.ch, provided it has not yet been redeemed. In case of timely withdrawal, we will refund the amount paid in full.

6.6 No liability for loss, theft, or unauthorised use.

7. Rights to image material

7.1 Copyright: the images are works protected by copyright within the meaning of the URG (Swiss Copyright Act). The copyright remains with Iris Foto Schweiz.

7.2 Usage licence: with payment, you receive a simple, non-exclusive, non-transferable usage licence for private, non-commercial use.

7.3 Included in the shoot price: digital file in 720 x 1280 pixels. Full-resolution files and printed products available separately at additional cost.

7.4 Only permitted with written consent: commercial use, editing/modification (including filters), passing on to third parties outside the private context, recreating/copying.

7.5 In case of use in breach of agreement: usage licence in the amount of 150% of the shoot fee, but at least 150% of the corresponding SAB tariff.

8. Use by Iris Foto Schweiz

8.1 We may use the images for our own advertising (website, social media, print material) provided you have given your express consent (model release).

8.2 Licensing to third parties only with written consent.

8.3 Without consent, your images are used exclusively for the agreed delivery.

9. Customer obligations

9.1 Punctual arrival at the agreed appointment.

9.2 You acknowledge that under certain health conditions (e.g. acute eye conditions, recent eye surgery) the iris photo shoot should not be carried out. When in doubt, please contact us in advance.

9.3 Notice of defects must be given in writing within 8 days of receipt. Otherwise, the service is deemed approved.

10. Liability

10.1 We are liable for damages caused intentionally or by gross negligence as well as for breach of essential contractual obligations.

10.2 For damages caused by slight negligence, we are liable only for the breach of essential contractual obligations and limited to damages typical for the contract and reasonably foreseeable.

10.3 Liability for consequential damages, lost profit, or indirect damages is — to the extent legally permissible — excluded.

10.4 No guarantee for the website's continuous availability and functionality.

11. Data protection

For the processing of your data, our Privacy Policy applies.

12. Amendments to the GTC

12.1 We reserve the right to amend these GTC.

12.2 Changes will be communicated at least 30 days before they take effect by email or notice on the website.

12.3 If you do not object within 30 days, the amended version is deemed accepted.

13. Final provisions

13.1 Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

13.2 Place of jurisdiction is the registered office of one idea gmbh, unless mandatory legal provisions provide for another place of jurisdiction. For consumers domiciled in the EU, the mandatory consumer protection rules on jurisdiction apply.

13.3 Should individual provisions be invalid or unenforceable, the validity of the remaining provisions remains unaffected.
